These terms apply to your use of this website and to any order you place with us. Agave Australis is a brand of Mt Uncle Distillery, 1819 Chewko Rd, Walkamin QLD 4872. By using this site or placing an order you accept these terms.
Age and liquor licensing
You must be 18 or over to buy alcohol in Australia, and to use the ordering parts of this site. It is an offence to supply alcohol to a person under 18, and an offence for a person under 18 to buy or attempt to buy alcohol. We may ask for proof of age at the point of sale or on delivery, and we may refuse or cancel any order where we are not satisfied that the purchaser is of legal drinking age. Using this website
The content on this site is provided for general information. Product descriptions, tasting notes and cocktail specifications are given in good faith but are not guarantees of a particular outcome. All text, photography, logos and design on this site are owned by or licensed to Mt Uncle Distillery and may not be copied, scraped or reused commercially without written permission.
Orders
An order placed through this site is an offer to buy. We may accept or decline it. A contract is formed when we confirm dispatch of your order. We may decline an order where stock is unavailable, where we cannot verify age or delivery details, where the delivery address is outside the areas we can ship to, or where a pricing or listing error has occurred.
Prices and payment
Prices are in Australian dollars and include GST unless stated otherwise. Delivery charges are shown separately at checkout. Payment is processed by Stripe at the time you place the order. If we discover an error in the price of an item you have ordered, we will contact you before dispatch and you can confirm the order at the correct price or cancel it for a full refund.
Small-batch variation
Agave Australis is made in small batches from a single crop. Colour, aroma and flavour vary a little between batches and harvests. That variation is a feature of the way the spirit is made, not a fault.

Your rights under the Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they are not of acceptable quality and the failure does not amount to a major failure. Nothing in these terms limits those rights.
Liability
To the extent permitted by law, and other than the guarantees that cannot be excluded, our liability for any claim relating to goods supplied is limited to replacing the goods or refunding the price paid. We are not liable for loss arising from misuse of alcohol, or from consumption contrary to health advice.
Responsible service
We support the responsible service and consumption of alcohol. We will refuse service to anyone who appears intoxicated, and we will not deliver to a person who is under 18 or unable to provide proof of age.
Third-party links
This site links to the Mt Uncle Distillery shop and to third-party stockists and venues. We are not responsible for the content, terms or privacy practices of sites we do not operate.
Privacy
Personal information you give us is handled in accordance with our Privacy Policy.
Changes and governing law
We may update these terms. The version published on this page at the time you place an order is the version that applies to that order. These terms are governed by the laws of Queensland, Australia, and the courts of that state have jurisdiction.
